On 20th January, the appeals panel of the Atyrau Regional Court upheld the verdict of Atyrau court No. 2 on 28.11.2016 on the verdict of civil activists Max Bokayev and Talgat Ayan as guilty of spreading false information about public events" (article 274, part 4, point 2 of the Criminal Code of the Republic of Kazakhstan), the initiation of social, national, ancestral, racial, class or religious strife (article 174, part 2) and violation of the order of organizing and holding meetings, rallies, pickets, street marches and demonstrations" (article 400). Based on these articles, the prosecution asked for the activists to be sentenced to eight years in prison. The court sentenced them to five years in a general regime colony and a three-year ban on public activity.
