Yanushkovskaya was accused of unauthorised picketing (Article 23.34 of the Administrative Code) based on a video she posted on social media, featuring her attending a Christmas party in a cafe. Prior to the trial, she was detained and held in a temporary detention centre. Yanushkovskaya suffers from asthma, but the detention centre refused to accept a package of medication for her. On 29 January, Vitebsk district judge Mikhail Zubenya, having examined Yanushkovskaya’s case, stated that “she cannot be re-educated” and imposed a sentence of seven days in prison.
